This Privacy Policy describes how Multiservicios Elite, LLC, doing business as Caxper ("Caxper," "Company," "we," "us," or "our") collects, uses, discloses, stores, and protects information in connection with the Caxper website, platform, and related services (collectively, the "Platform"). Caxper is a business-management platform designed for insurance professionals and their authorized staff. This Policy applies to information collected from account holders, trial users, website visitors, support contacts, billing contacts, and other individuals who interact with the Platform. By accessing or using the Platform, or by submitting information to us in connection with the Platform, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Policy, you should not use the Platform.
Important role distinction: when you create an account, purchase a subscription, visit our website, or contact us directly, we generally control how that information is processed for our own business purposes. When you upload or enter customer, prospect, policy, commission, appointment, or similar records into the Platform, we generally process that information on your behalf in order to provide the Platform to you. You remain responsible for making sure you have an appropriate legal basis, notice, and permissions for the data you place in the Platform.
1. INFORMATION WE COLLECT
We may collect the following categories of information, depending on how you use the Platform and what features you choose to use:
1.1 Account, Identity, and Professional Information
- Name, email address, phone number, mailing address, and account credentials.
- Company, agency, team, or organization name.
- National Producer Number (NPN), state license numbers, appointment-related information, and other professional licensing details you choose to provide.
- User role, permissions, language preferences, and profile settings.
1.2 Client, Prospect, and Business Records You Upload or Enter
- Names, contact information, demographic information, policy details, carrier data, product type, effective dates, status, notes, reminders, commissions, renewals, residuals, expenses, uploaded files, and similar records you or your authorized users enter into the Platform.
- Communications history, follow-up notes, tags, exported files, and other business records you choose to manage through the Platform.
1.3 Billing and Commercial Information
- Subscription plan, billing profile, transaction history, invoices, receipts, refunds, coupon or promotional information, and account status.
- Limited payment-related information from our payment processor. We do not store complete payment card numbers in our systems.
1.4 Device, Usage, and Technical Information
- IP address, browser type, device identifiers, operating system, language settings, approximate geolocation derived from IP, referral URLs, and timestamps.
- Pages viewed, features used, clickstream data, session duration, logs, crash reports, diagnostics, and performance metrics.
- Security-related logs used to investigate abuse, suspicious activity, account misuse, and system integrity issues.
1.5 Communications and Support Information
- Emails, chat messages, support tickets, call notes, submitted feedback, survey responses, feature requests, and similar communications with us.
- Any documents or screenshots you send to us for support, troubleshooting, implementation, or onboarding.
1.6 Cookies and Similar Technologies
We may use cookies, pixels, local storage, and similar technologies to keep you signed in, remember preferences, measure performance, improve usability, and help secure the Platform.
2. SOURCES OF INFORMATION
We collect information directly from you, from your authorized users, from your use of the Platform, from payment processors and service providers, from integrations you choose to connect, and from publicly available or third-party sources when reasonably necessary to verify business identity, account ownership, licensing status, or fraud and security risks.
3. HOW WE USE INFORMATION
We use information for legitimate business and operational purposes, including to:
- Create, authenticate, administer, and secure accounts.
- Provide, operate, maintain, support, and improve the Platform and its features.
- Process subscriptions, payments, renewals, cancellations, credits, and related billing matters.
- Store, organize, display, export, and otherwise process records you choose to manage through the Platform.
- Respond to customer service requests, onboarding questions, and technical issues.
- Send transactional communications such as receipts, login alerts, service notices, password resets, billing updates, and policy or terms updates.
- Monitor usage trends, troubleshoot errors, audit performance, and improve features, reliability, and user experience.
- Detect, investigate, prevent, and address fraud, abuse, unauthorized access, data loss risks, and violations of our Terms & Conditions.
- Enforce our agreements, establish or defend legal claims, comply with legal obligations, and respond to lawful requests from courts, regulators, insurers, law enforcement, or governmental authorities.
- Generate de-identified or aggregated analytics, benchmarks, and operational insights that do not reasonably identify you or your customers.
4. HOW WE DISCLOSE INFORMATION
We do not sell personal information for monetary consideration. We do not disclose personal information to third parties except as reasonably necessary for the purposes described in this Policy or as otherwise permitted or required by law.
4.1 Service Providers and Contractors
We may disclose information to vendors and service providers that help us operate the Platform and our business, such as hosting providers, infrastructure providers, analytics providers, customer support tools, communications vendors, security vendors, document processing vendors, and payment processors. These parties are authorized to use information only as reasonably necessary to provide services to us or on our behalf.
4.2 At Your Direction or Through Integrations
If you connect a third-party integration, export data, invite other users, or otherwise direct us to share information, we may disclose information as needed to complete your request. Your use of third-party integrations is subject to the privacy practices and terms of those third parties.
4.3 Legal Process, Protection, and Compliance
We may disclose information if we believe in good faith that disclosure is reasonably necessary to comply with applicable law, regulation, subpoena, court order, governmental request, or insurance-regulatory inquiry; to investigate or enforce our rights; to protect the Platform, our users, or the public; or to prevent fraud, abuse, or security incidents.
4.4 Corporate Transactions
Information may be disclosed as part of an actual or proposed merger, financing, acquisition, sale of assets, bankruptcy, restructuring, or other corporate transaction. In that event, information may be transferred subject to customary confidentiality and transaction safeguards.
4.5 With Consent
We may disclose information for other purposes where you direct us to do so or where you otherwise provide legally sufficient consent.
5. DE-IDENTIFIED AND AGGREGATED INFORMATION
We may create de-identified, anonymized, or aggregated information from data processed through the Platform, provided that such information does not reasonably identify a specific individual. We may use that information for analytics, product improvement, reporting, statistics, capacity planning, service development, and other lawful business purposes.
6. COOKIES, ANALYTICS, AND SIMILAR TECHNOLOGIES
We may use essential cookies to operate the Platform, preference cookies to remember settings, and analytics technologies to understand usage and improve performance. You may be able to adjust cookie settings through your browser or device controls; however, blocking certain cookies may impair the functionality, security, or usability of the Platform. Unless and until we state otherwise in an updated policy, the Platform is not intended to rely on cross-context behavioral advertising to provide core services. If our practices materially change, we will update this Policy and provide any notices or choices required by applicable law.
7. IMPORTANT NOTICE REGARDING CLIENT DATA, PHI, AND SENSITIVE INFORMATION
The Platform may be used to manage sensitive insurance-related business records, but it is not offered as a HIPAA-compliant repository for Protected Health Information (PHI). Do not upload, enter, transmit, or store PHI in the Platform unless and until Caxper has expressly agreed in a separate written contract to support such processing and, if legally required, executed a Business Associate Agreement. You are solely responsible for determining what information is appropriate to place in the Platform, for providing required privacy notices to your customers and prospects, and for obtaining any required consents, authorizations, or other legal permissions before submitting data to the Platform. We may also collect or process certain information that may be considered sensitive under some privacy laws, such as account credentials, professional license numbers, or precise financial transaction details related to subscriptions. We use such information only as reasonably necessary to provide and secure the Platform, administer accounts, process payments, comply with law, and protect against fraud or abuse.
8. DATA RETENTION
We retain information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Platform, maintain business and tax records, resolve disputes, enforce agreements, comply with legal obligations, preserve security logs, and support legitimate backup and disaster recovery processes. Retention periods may vary depending on the type of information, the nature of the account, whether the account is active or closed, whether there is an unresolved dispute or investigation, and whether the information must be retained for accounting, tax, audit, security, or legal reasons. When information is no longer reasonably necessary, we may delete it, anonymize it, or retain it in backup or archival systems for a limited period as part of routine technical processes. Residual copies may persist temporarily in backups, logs, and disaster recovery systems.
9. DATA SECURITY
We use commercially reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, alteration, disclosure, or destruction. These measures may include access controls, authentication mechanisms, encryption in transit, system monitoring, backup procedures, vendor controls, and other safeguards appropriate to the nature of the Platform and the information involved. No system can be guaranteed to be completely secure. Accordingly, we do not warrant or guarantee that information will never be accessed, disclosed, altered, or destroyed through a breach of our safeguards, software vulnerabilities, human error, or malicious acts. You are responsible for keeping account credentials confidential and for notifying us promptly of suspected unauthorized access or other security concerns.
10. YOUR PRIVACY RIGHTS
Depending on your location and applicable law, you may have certain rights regarding personal information we control about you, which may include the right to request access, correction, deletion, portability, restriction, appeal, or information about our disclosure practices. These rights are subject to important exceptions and limitations under applicable law. If you submit a rights request, we may need to verify your identity and your authority to make the request before responding. We may deny or limit requests where permitted by law, including where we cannot reasonably verify your identity, where the request concerns information we process only on behalf of another user, or where retention is required for security, legal, fraud prevention, contractual, tax, or operational reasons. If applicable law requires us to offer an appeals process after denying a request, we will provide instructions at the time of our response.
10.1 California Residents
If you are a California resident, you may have rights under California privacy law, including the right to know, access, correct, delete, and obtain information about categories of personal information collected, disclosed, or retained, subject to statutory exceptions. California residents may also use an authorized agent where permitted by law. We will respond to verifiable California requests within the period required by applicable law. Where permitted, we may extend the response period after notifying the requestor. We will not discriminate against you for exercising rights granted by law.
10.2 How to Submit Requests
You may submit privacy requests by emailing support@caxper.com. If you are acting as an authorized agent, we may require proof of your authority and may also require the relevant individual to verify identity directly with us.
11. U.S. STORAGE AND TRANSFERS
The Platform is operated in the United States. Information may be stored and processed in the United States and in other locations where our service providers maintain operations. By using the Platform, you understand that information may be transferred to and processed in jurisdictions that may not provide the same level of legal protection as your home jurisdiction.
12. THIRD-PARTY LINKS AND SERVICES
The Platform may contain links to third-party websites, carrier portals, payment processors, communications services, or other third-party services. This Privacy Policy does not apply to third-party products or services, and we are not responsible for their privacy, security, or data handling practices. You should review the privacy policies and terms of any third-party services you choose to use.
13. CHILDREN'S PRIVACY
The Platform is intended for business use by adults and is not directed to children under 18. We do not knowingly collect personal information directly from children under 18. If we learn that we have collected information directly from a child in violation of applicable law, we will take reasonable steps to delete it.
14. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect changes in the Platform, our practices, or applicable legal requirements. When we make material changes, we may update the Effective Date, post the revised Policy on the Platform, and provide additional notice where required by law or where we determine such notice is appropriate. Your continued use of the Platform after an updated Policy becomes effective means you acknowledge the revised Policy.
